Mailbox Location, Installation or Replacement
The United States Postal Service, Palmyra Office, establishes postal routes and determines the proper location of residents' mailboxes. LMOA Maintenance employees install the boxes according to the mail carrier routes. Please keep the area around your mailbox free from snow/ice accumulations to assure delivery of your mail during the winter.

Environmental Control rules require that mailboxes with space for newspapers are provided and installed by LMOA to assure a standard appearance; therefore all replacement mailboxes must be purchased through LMOA. Maintenance of the box is the responsibility of the property owner. All mailboxes must be their original black color and no other colors or decoration are permitted. Newspaper tubes are prohibited; mailboxes are constructed to provide space for newspapers and other deliveries below the mailbox.

Owners may request installation of a mailbox or a replacement, at the current fee, through the Administration Office. Please allow one week for completion.

Trash Collection and Recycling
Lake Monticello provides roadside trash collection and recycling pickup by Waste Management (WM) for all completed homes. The annual Improved Property Fee charged each homeowner includes the cost of trash collection and recycling.

Once a new home is completed, the owner may contact the Administration Office to order trash and recycling containers and to begin service. A pick-up schedule and instructions also are available at the Office.

Trash containers should be placed at the end of the driveway, not on the street, on the evening before the regularly scheduled pick-up day. Both the trash and recycling bins should be returned to an inconspicuous location as soon as possible after pick up.

Changes to the pick-up schedule will be announced in the Association media.

In the event that Waste Management fails to pick up trash or recycling on the regularly scheduled day, please call 434-589-8263 or email the Administration Office. Residents who expect to have a larger than normal pick up also should call the Administration Office in advance.

The Environmental Control Committee (ECC) exercises the rights vested in the Lake Monticello Owners’ Association by the Covenants, Restrictions and Reservations included in the Statements of Subdivision and administers the Environmental Control Rules and Regulations adopted by the Board of Directors. The ECC Rules and Regulations are embodied in LMOA Policy Manual Chapter 13.

The ECC meets weekly* to consider applications for new home construction, additions, alterations or improvements to the exterior of any home or lot, with the exception of routine landscaping. The ECC’s jurisdiction extends to driveway paving, exterior colors and materials, fences, retaining walls, shore walls and docks, dredging, erosion control and storm water management, signs, unsightly lots, and much more. The ECC also issues the Virginia Property Owners’ Association Act Disclosure Packet upon receipt of a completed application and the applicable fee.

LMOA staff and the Social & Recreation Committee promote community activities through regularly scheduled social, educational and athletic events such as the UVA Rowing Championships, 4th of July Celebration, Octoberfest, Craft Shows, teen and children’s activities and other specially planned events. Contact the Administration Office or consult the Friday Flyer for more information.

As Lake Monticello grows, the demand for space for meetings and social events increases. LMOA Board and committee meetings, social and other group meetings and events, bridge and other card players, line dancers, aerobics, quilters, special luncheons, and a number of other functions fill the Association facilities on most days and evenings. Consult the Friday Flyer and cable channel 14 for the schedule of events.

To schedule a meeting or other function, regardless of the size of the event, please contact the Administration Office at (434) 589-8263, extension 101, or email events to make arrangements. This will ensure that space will be reserved and that your event does not infringe on other events.

Lake Monticello Volunteer Fire Department and Rescue Squad (LMF&RS)
Fire and Rescue building is located across from Lake Centre Shopping Center on Slice Road near the intersection with State Route 600, just outside the Fairway (Slice Road) Gate to the community.

Lake Monticello Volunteer Fire Department and Rescue Squad provide fire protection emergency to people and property and medical treatment for anyone within the Lake Monticello community or in Fluvanna County as required. Lake Monticello Water Rescue (LMWR) is an all-volunteer organization based out of the Lake Monticello Volunteer Fire Department. Since 1987, LMWR has been responding to water emergencies within Fluvanna and Albemarle County as well as the entire commonwealth of Virginia and surrounding states. LMWR members are trained in swiftwater rescue, SCUBA, ice rescue; high and low angle rope rescues, and boat handling.  See the LMWR website for more details.

The Squads conduct fundraising activities to provide operating funds. These activities include Friday night Bingo, an annual fund drive, and the annual Oscar Hallman Fire and Rescue Golf Tournament. The Fire and Rescue Squad Auxiliary is active and supportive of these events. Volunteers are always welcome. Visit the LMF&RS web site.

Police, Security and Entry to the Community
The Lake Monticello community is a private community, patrolled 24 hours a day by our own police force. At least one police officer is on duty at all times. Enforcement of the Policies, Rules and Regulations of the Association is the responsibility of the Police/Security force. A staff of Security officers monitors entry into the gated sections.

Lake Monticello’s Police officers are appointed by the Circuit Court and have full arrest powers and responsibilities. Police officers must successfully complete the Virginia mandated training prior to receiving State certification as police officers.

Rules and regulations to ensure the integrity of the secured Lake Monticello community are embodied in Policy Manual Chapter 19.

The owner(s) of each residential lot in the subdivision automatically becomes a member of the Lake Monticello Owners’ Association in accordance with the Articles of Incorporation and Bylaws, and is entitled to all the rights and privileges according to the Association’s governing documents, including the Articles of Incorporation, the Statements of Subdivision, the Bylaws and the Policy Manual. In addition, each owner agrees, by accepting conveyance of or interest in a lot within the subdivision, to abide by the rules, regulations, policies and procedures as provided by those documents, including the payment of such charges and levies as may be properly made by the Association.

Meetings of LMOA Members
In accordance with the Bylaws, LMOA holds an annual meeting of members on the last Saturday of June of each year, at which members will vote to fill vacancies on the Board of Directors and vote on Board and member proposals that have met the legal requirements for being placed on the meeting agenda. In addition, the Bylaws provide that the Board or Association members may call special meetings of members to vote on special issues.

Notices of annual and special meetings of members are mailed to all members of record. Accompanying each notice is a proxy and pre-addressed, return envelope. The Board urges members to exercise their voting rights: Read the notice completely, fill out and sign the proxy, and return it to the Administration Office before the stated deadline.

Member Dues, Fees, Assessments
The maximum amount of annual dues the Association can charge members is set by a vote of the membership. The improved property fee is charged at cost to owners of all completed homes to cover the expense of trash and recycling pickup and snow plowing of Lake Monticello streets. Should the need arise, the Board of Directors may petition members for special assessments, according to the provisions of the Virginia Property Owners’ Association Act and the Bylaws. Any such assessment would require member approval to be effective. (See Policy Manual Chapter 1, Section 1.02)

Other fees will be charged at the time of application for amenity use and Environmental Control functions, as provided in Policy Manual Chapter 13, Environmental Control Rules and Regulations.

Compliance charges may be made when violations of LMOA covenants and restrictions or policies, rules and regulations are confirmed by the Compliance Committee.

Tenant Fees
Policy Manual Section 15.01, Leasing of Property, requires that an annual tenant registration fee be paid in addition to the membership dues and improved property fees on rented homes. The property owner may choose to charge this amount to the tenant; however, the payment of this fee to the Association is the responsibility of the property owner. See the policy for exceptions and additional information about rental of property.

Member Billing
Members will be billed for annual membership dues on each lot or Marina Point unit, the Improved Property Fee for each completed residence and other applicable fees. Inquiries about billing can be made by calling the Business Management Department at Administration Office.

Property Transfer Fee
A Property Transfer Fee of $500.00 shall be imposed on the purchaser of an improved or unimproved lot or Marina Point unit in accordance with LMOA Bylaws Article 8, Dues & Assessments, Section 8.03, as approved by LMOA members on June 29, 2002.

Transfer of Property – Membership
Membership in the Lake Monticello Owners’ Association cannot be transferred except by transfer of the property. Membership is automatic and cannot be canceled or waived by an owner.

Settlement of account balances and proration of dues and fees must be handled at the time of the closing on property transfers. Owners are required to offer a prospective buyer a disclosure packet, as required by the Virginia Property Owners’ Association Act, which contains valuable information about the Association; membership obligations; the individual property, including any account balance; etc.

Delinquent Accounts
Lake Monticello Owners’ Association has the authority to seek payment of all dues, fees and assessments, and may take whatever steps are necessary to collect delinquent accounts. Policy Manual Section 4.02n describes the process LMOA must follow.
